French drain below siding blocked and overflowing

The current overflow, immediately below the railway sidings and between the 2 rail bridges that cross the river, has been ongoing for 2 or 3 months now. The path is getting very slimy and there is a risk of slipping. The intermittent problem has existed for many years and the drain needs regular (once a year?) maintenance. After a debate between residents, Council, TOCs and Network Rail a dozen or so years ago, Network Rail took on the maintenance and have done it very efficiently. However, with a change of team at NR, they have found a MAP Agreement ref. PBO06601, dated 14.10.1994, in which the Council undertook to widen the pathway, install a French drain and provide ongoing maintenance. It therefore appears to be the Council’s responsibility to clear this French drain, despite more than a decade of NR undertaking the task when it was not, in fact, their responsibility. The leak is unsightly for users of the path and leaves a slimy deposit. It also freezes over in cold weather. Both conditions cause a potential hazard for someone who may slip over there.

Our contractors have undertaken the necessary works to restore the flow of water and clean the tarmac surfacing, this is all work carried out without prejudice as this section of surfaced cycleway walkway is not adopted public highway, additionally our Highways Department need to investigate this MAP Agreement ref. PBO06601 as the drainage system is only in place to take surface/ground water run off from the third party's land.
