Overhanging/grown trees blocking light

I am writing to you for advice regarding who is responsible for pruning the elderberry trees along my fence behind 93 Welland Road/recreational ground. I have noticed that they have damaged fence due to the size. Another concern is the height looking to be well over 40 ft cutting out all the afternoon sun. My enquiry relates to who is responsible for the upkeep and for consequences of falling branches common with this species. I would request that if the council is responsible that the trees be cut back in height to perhaps half before the birds start to nest. The trees are very nice but there is a problem in that they are not being maintained and of course the fact that they are damaging my fence. Many Thanks
